DECREE OF THE PRESIDENT OF THE REPUBLIC OF DAIKOKU No. 1 of 3 November 2014 ON THE INTERIM CONSTITUTION OF THE REPUBLIC OF DAIKOKU [1I, MIGS CALDEO, President of the Republic of Daikoku, decided on the following on 3 November 2014 in the city of Nakatani in the Republic of Daikoku for the purpose of introducing an interim constitution for the Republic of Daikoku. This decree was amended on 12 November 2014 by the Territory Law of 2014. ARTICLE 1 (1) The Republic of Daikoku is a democratic and independent unitary state with a parliamentary form of government under the rule of law and within the principles of international law. (2) The Republic of Daikoku shall exercise sovereignty and jurisdiction over its territories and shall represent the interests of the Daikoku people. (3) The Republic of Daikoku shall be known as Daikoku in its short form. ARTICLE 2 (1) The territory of the Republic of Daikoku shall consist of the following: (1) the city of Nakatani, the capital city of the Republic of Daikoku, (2) the city of Kitakyo, (3) the city of Seidaikei, (4) the commune of Fujimiya, (5) the commune of Kirino, (6) the commune of Kotori, (7) the commune of Nishizumi, (8) the commune of Shiba, and (9) the special commune of Kawashiro. (As amended by the Territory Law of 2014 on 11 November 2014) [1] (2) The territory of the Republic of Daikoku can be changed through relevant legislation. (3) The Defense Force of the Republic of Daikoku shall be tasked with the defense of the territories of the Republic of Daikoku. ARTICLE 3 (1) The flag of the Republic of Daikoku shall be a horizontal bicolor consisting of the colors yellow and green, with the ratio of its length to its width being 2:3. (2) The national anthem of the Republic of Daikoku shall be "Our Daikoku". (3) The national motto of the Republic of Daikoku is "Our beloved Daikoku, our great homeland". (4) The official languages of the Republic of Daikoku are English and Filipino. (5) The Republic of Daikoku can determine national symbols through relevant legislation. ARTICLE 4 The sovereignty of the Republic of Daikoku shall belong to the Daikoku people. ARTICLE 5 (1) The Republic of Daikoku shall be a secular state. (2) The Republic of Daikoku shall be a multi-party state and shall exercise political plurality. (3) The Republic of Daikoku shall recognize the division of powers within the government. (4) The Republic of Daikoku shall be a social state which shall prioritize the interests and needs of its people. (5) The Republic of Daikoku shall ensure the development of the nation. (6) The Republic of Daikoku shall pursue for peaceful and productive diplomatic relations with foreign states. ARTICLE 6 The Republic of Daikoku shall seek to unify with the Rajahnate of Namayan in a federal form of government based on the principle of mutual cooperation and development. ARTICLE 7 (1) The following are citizens of the Republic of Daikoku: (1) those who are citizens of the Democratic People's Republic of Urbonia and the Margraviate of Misaka as of 3 November 2014, (2) those who are citizens of the Kingdom of Treisia as of 3 November 2014 who have announced their intention of acquiring the citizenship of the Republic of Daikoku, (3) those whose father or mother are citizens of the Republic of Daikoku, and (4) those who have acquired citizenship through naturalization. (2) The following are no longer citizens of the Republic of Daikoku: (1) those who have intentionally acquired the citizenship of a foreign state and renounced the citizenship of the Republic of Daikoku, (2) those who are citizens of the Daikoku Federation as of 3 November 2014 who have not acquired the citizenship of the Republic of Daikoku, and (3) those who have committed grave crimes in the Republic of Daikoku. ARTICLE 8 (1) All citizens of the Republic of Daikoku shall be equal under the law. (2) All citizens shall have the right to life. (3) All citizens shall have the right to the freedom of person, unless in the case of arrest through an order of the Supreme Court of the Republic of Daikoku or in the case of flagrant arrest. (4) All citizens shall have the right to jurisdiction, to ruling in accordance to the law, to fair trial, to counsel, to a trial concluded within a reasonable time, to the presumption of innocence until proven guilty, to be informed of the charges filed against them, not to declare themselves guilty, not to testify against themselves or their relatives, and to appeal decisions of the Supreme Court. (5) All citizens shall have the right to personal dignity and integrity, and to privacy of all forms unless in the case of a decision of the Supreme Court and in the case of flagrant arrest. (6) All citizens shall have the right to the freedom of movement and residence. (7) All citizens shall have the right to seek assistance from the Republic of Daikoku. (8) All citizens shall have the right to the freedom of expression and education, unless if this is contrary to the interests of the government and society of the Republic of Daikoku. (9) All citizens shall have the right to belief. (10) All citizens who have reached the age of 16 shall have the right to vote, to be a candidate in elections and to be appointed in government offices, unless in the case of a decision of the Supreme Court. (11) All citizens shall have the right to association and to assembly. (12) All citizens shall have the right to work and enterprise. (13) All citizens shall have the right to legally own property. (14) All citizens shall have the right to creative and cultural activities. (15) The family shall be protected by the Republic of Daikoku. (16) The environment shall be protected by the Republic of Daikoku. (17) The Republic of Daikoku shall guarantee the rights of consumers. (18) All citizens shall have the duty to preserve social order and the way of life in the Republic of Daikoku. (19) All citizens shall have the duty to protect the Republic of Daikoku through either military service or alternative civil services. (20) All citizens shall have the duty to show loyalty to the Republic of Daikoku. (21) All citizens shall have the duty to observe this constitution and the laws, and to respect the rights of other citizens. (22) The Republic of Daikoku may introduce additional rights and duties through relevant legislation. (23) Foreign citizens and stateless persons shall enjoy all the rights reserved to the citizens of the Republic of Daikoku. (24) The Republic of Daikoku shall grant asylum to foreign citizens and stateless persons. (25) The Republic of Daikoku may extradite persons, unless in the case of extraditing foreign citizens and stateless persons who have acquired asylum and have not committed any crimes within the Republic of Daikoku. ARTICLE 9 (1) The President of the Republic of Daikoku is the head of state of the Republic of Daikoku and he exercises executive powers. (2) The President shall have the following powers: (1) Appoint the Prime Minister of the Republic of Daikoku with the approval of the Parliament of the Republic of Daikoku, (2) Chair meetings with the Parliament, (3) Appoint the Supreme Judge and Deputy Judge of the Supreme Court, (4) Serve as Supreme Commander of the Defense Force of the Republic of Daikoku, (5) Promote and demote personnel of the Defense Force, (6) Represent the Republic of Daikoku in foreign affairs, (7) Introduce bills to be approved in the Parliament, (8) Approve bills approved by the Parliament into laws, and (9) Issue decrees. (3) In the case that the President shall be unable to perform his duties, the Prime Minister shall become Acting President. ARTICLE 10 (1) The Parliament of the Republic of Daikoku is the legislative and representative body in the Republic of Daikoku. (2) Danielle Lintag, the Premier of the Daikoku Federation, shall become the Prime Minister of the Republic of Daikoku until the appointment of a new Prime Minister in accordance to the provisions of a new constitution or in accordance to the procedures of appointment by the President. (3) The Parliament shall be responsible for the deliberation and voting of bills that are to be introduced by the President. (4) The Parliament shall also serve as the advisory body to the President. (5) In the case of the Prime Minister shall be unable to perform his duties, the President shall appoint a deputy of the Parliament to become the new Prime Minister. (6) In the case of a vacancy in the Parliament, the President shall appoint a new deputy to fill in the vacancy. ARTICLE 11 (1) The Supreme Court of the Republic of Daikoku is the judicial body in the Republic of Daikoku. (2) No other courts may be established in the Republic of Daikoku. (3) The Supreme Court shall consist of a Supreme Judge and a Deputy Judge appointed by the President. (4) The Supreme Court shall be responsible for administering justice in the Republic of Daikoku and the interpretation of this constitution and the laws. ARTICLE 12 (1) A Constitutional Commission consisting of the President, the Parliament and the Supreme Court shall be convened within 90 days after this constitution goes into effect. (2) The work of the Constitutional Commission shall last for 30 days. (3) The draft Constitution by the Constitutional Commission shall be placed into a referendum within 30 days after the conclusion of the work of the Constitutional Commission. (4) In the case that the work of the Constitutional Commission overlaps with the work of a constitutional commission formed once the Republic of Daikoku and the Rajahnate of Namayan achieves unification, the work of the Constitutional Commission of the Republic of Daikoku shall be suspended until the new constitution of the unified states has been approved. (5) In the case that the new Constitution of the Republic of Daikoku has been approved before the approval of a new constitution of the unified states of the Republic of Daikoku and the Rajahnate of Namayan, the Constitution of the Republic of Daikoku shall be amended in accordance to the constitution of the unified states.
